Welcome to the Clearpath Privacy Policy (“Privacy Policy"). Clearpath is owned and operated by Authentic, Inc. and any affiliates (collectively, “we,” “our,” “us,” "Authentic" or “Clearpath”). Please read this Privacy Policy carefully before using the Clearpath Platform.
This Privacy Policy governs our data collection, processing and usage practices. We update this Privacy Policy periodically. We will post any privacy policy changes on this page and, if the changes are significant, we will provide more prominent notice by sending you an email notification.
Defined terms have the meanings set forth herein when capitalized, and may be read in singular, plural or an alternative tense, as the context requires. Any capitalized terms not defined herein shall have the meanings set forth in the Patient Terms & Conditions (www.myclearpath.com/legal/patient-terms).
2.1. Providing information to Clearpath. By becoming a user of Clearpath, you voluntarily and willfully provide Authentic with certain information, which may include personally identifiable information and/or protected health information, collected by Authentic to provide the Services.
2.2. Clearpath-connected Facilities. Authentic enters into agreements with healthcare facilities, medical imaging centers, health system release of information offices, and other clients Authentic may serve (each a “Facility” and pluralized as “Facilities”) to provide the Authentic Services. The use of the Authentic Services by Facilities is governed by the Clearpath Facility Terms & Conditions (www.myclearpath.com/legal/facility-terms) and/or other applicable instruments executed between Authentic and each Facility, including, where applicable, HIPAA Business Associate Agreements.
2.3. Patients. Patients may request and/or receive records and medical radiology images from any Facility via the Authentic Services. Facilities have the option to configure Clearpath to either: (a) automatically release records and imaging to patients following an appointment, or (b) require patients to first submit a request prior to releasing the patient’s records. The use the Authentic Services by Patients is governed by the Clearpath Patient Terms & Conditions (www.myclearpath.com/legal/patient-terms).
2.4. Becoming a Clearpath user. You may become a Clearpath user by being provided a Clearpath account as a healthcare provider, Facility employee, or authorized third party, or by requesting and/or receiving records from a Facility as a patient or authorized delegate. If you have any hesitations or concerns about providing information to us, having your information used in a manner consistent with our Privacy Policy, then you should not become a user of Clearpath and, if you are already a user, you may request to have your account deleted by contacting support@myclearpath.com.
3.1. When you visit our websites. You are free to visit our websites without providing any Personal Information (defined below). If you create an account and/or submit a request for records through the Services, we may request that you provide Personal Information about yourself. We collect Navigational Information (defined below) with respect to how users navigate our websites and applications.
3.2. When you use our mobile applications. We use mobile analytics software to better understand the functionality of our mobile apps. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from. In addition to information we collect on our websites, when you use our mobile apps we may also collect your city location, device model and version, device identifier (or “UDID”), OS version, and your Clearpath user credentials. We may send push notifications from time to time to update you about relevant status information pertaining to your Requests. If you no longer wish to receive such communications, you may turn them off in your device’s settings. We may link information we store within the analytics software to Personal Information you submit within the mobile app. We do this to improve services we offer you and improve our marketing, analytics and site functionality.
3.3. Personal Information. By using the Services, you may provide certain Personal Information to Authentic. This Personal Information may be required in order to receive specific services. By providing such information, you are agreeing that Authentic may store, process, and review such information. Authentic may use this information for the purpose for which it was collected, and this information may be stored for as long as is necessary to provide you with our services. “Personal Information” means any information you voluntarily submit to us and that identifies you personally, including contact information such as your name, e-mail address, company name, address, phone number, and other information about yourself or a family member, if you are requesting or receiving records as a delegate on their behalf. Personal Information may include information submitted to Authentic: (a) by you as part of any request to receive records from a Clearpath-connected healthcare provider via the Services; and/or (b) by your healthcare provider as part of any records that you receive from the healthcare provider via the Services. Personal Information may also include: (a) Navigational Information; (b) Payment Information; and (c) Protected Health Information (each defined below), where such information can directly or indirectly identify an individual.
3.4. Navigational Information. “Navigational Information” means information about your computer or mobile device and your visits to our websites or apps, such as your IP address, geographical location, browser type, referral source, length of visit, and pages viewed. We collect Navigational Information for website and mobile app users.
3.5. Payment Information. “Payment Information” means information we may collect and process from you, including credit cards numbers and billing information, when you complete a paid transaction via the Services. We collect and process Payment Information using third party PCI-compliant service providers.
3.6. Protected Health Information. “Protected Health Information” or “PHI” means identifiable health information that may be transmitted or maintained by Authentic. We may collect, transmit, and maintain PHI and other sensitive information in the course of providing the Authentic Services. PHI may include, without limitation: A person’s physical or mental health condition (past, present, or future); The provision of health care to the individual; The payment for health care ; Plus, any data that identifies the individual, such as: Name; Address; Date of birth, Social security number; Medical record number(s); Email address; Phone number; Drivers license; Biometric data; Full face photographs; Medical records; and Medical radiology imaging.
3.7. Information You Input into the Services. Please note that any information that you voluntarily submit in a records request to any Facility will be made available and viewable by that Facility. It is up to Clearpath users to be aware of what information they are sharing in any request to any Facility. Authentic accepts no responsibility or liability for any private information that was inadvertently to any Facility incorrectly. 3.8. Ways Users Share Information with Clearpath.
(a) Creating a Clearpath account: You may create a Clearpath account from the Clearpath websites and/or mobile applications. To sign up for an account, you are required to provide your name, email address and a password.
(b) Submitting records requests to a Facility: When you submit a request for records from any Facility, the personal information you share when submitting the request is shared with the Facility. By submitting any request, you are opting into sharing the information you provide on the request form with the Facility, and you are giving them permission to use that information to validate your request, release any records matching the parameters of your request to you, and contact you directly to fulfill your request.
(c) Receiving records from a Facility: We may receive information about you from a Facility you visit to the extent that both you and the Facility have opted into the automatic release of your records to you via the Authentic Services.
(d) Payment information: We may ask you to provide payment information to allow you to pay for any services requiring payment. In order to fulfill your requests for paid services, we share your payment information with payment processors. For more information on this topic, please see the section about how we share your information with vendors, below.
(e) Correspondence between you and Authentic: We may correspond with you using email, chat or text messages, notices on the Clearpath website and other communication methods.
(f) Electronic identification data: When you view and interact with our Services, we also collect your IP addresses, your operating system type, your web browser type, URLs of websites in which you arrive or leave the Clearpath website, and other similar information.
(g) Cookies: Cookies allow us to recognize you and personalize your experience.
(h) Mobile Applications: When you view and interact with our Services, we also collect your IP addresses, your operating system type, your web browser type, URLs of websites in which you arrive or leave the Clearpath website, your mobile carrier or service provider, your Internet service provider (“ISP”), and other similar information.
(i) Third-party services: We will receive your prior consent before you interact with third-party services available through our Services.
4.1. We Never Sell Personal Information. We use the information we collect only in compliance with this Privacy Policy. We will never sell your Personal Information to any third party.
4.2. How We Use Your Information. We use the information you provide to: Provide you with Services; Intake, process and fulfill your requests and payment orders made via our Services; Provide you with customer support and help with troubleshooting problems; Develop and improve our Services; Perform and support our internal operations such as troubleshooting, data collection and analysis, testing, verification, research, development and service improvements; Enable you to share information and communicate with other users; Develop and improve the services offered by third parties; Determine your geographical location; Send you service or promotional information via email, text messages, and notices on the Clearpath website; Administer your user account.
4.3. Sharing Your Information With Facilities. When you submit a records request to a Facility via the Services, you consent to providing your Personal Data to Facility as specified in your request. These Facilities are healthcare providers who are required by law to protect your Personal Information, but they are third party entities that are not affiliated with us. You agree that after we transmit your personal information to a Facility, we are not responsible for the actions of these Facilities with respect to your Personal Information. It is important that you review the applicable policies of the Facilities before providing Personal Information.
4.4. Your Consent. We will normally collect personal information from you only where we have your consent to do so, where we need the personal information to perform a service you authorize, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to collect personal information from you. If we ask you to provide personal information to comply with a legal requirement or to perform a contract with you, we will make this clear at the relevant time and advise you whether the provision of your personal information is mandatory or not (as well as of the possible consequences if you do not provide your personal information). Similarly, if we collect and use your personal information in reliance on our legitimate interests (or those of any third party), we will make clear to you at the relevant time what those legitimate interests are.
4.5. Information Security Program. User data (including Personal Information, financial information, and uploaded content) is stored securely in the cloud using industry-standard encryption and data protection practices as maintained as part of our information security program (the “Information Security Program”). We never make this information available to anyone, and we take security very seriously.
5.1. Legal Requirements & Government. Authentic may disclose personal information to respond to legal requirements, exercise our legal rights or defend against legal claims, to protect Authentic’s interests, fight against fraud and to enforce our policies or to protect anyone’s rights, property, or safety.
5.2. Suppliers, Vendors, and Sub-processors. Authentic may partner from time to time with third party companies, including without limitation Amazon, Google, Microsoft, Hubspot, Salesforce, and Scanslated to provide technology infrastructure and features that are part of and enable the Services (each a “Sub-processor” and collectively “Sub-processors”. Authentic contracts directly with these companies shares information electronically with these companies in order to provide the Services, and the data integration with each Sub-processor is subject to the rigorous controls in place as part of the Information Security Program.
5.3. Service Providers. We may employ other companies and people to provide services to customers and users and may need to share your information with them to provide information, products or services to you. Examples may include analyzing data, processing credit card payments, supplementing the information you provide us in order to provide you with better service, and providing customer service or support. In all cases where we share your information with such agents, we explicitly require the agent to acknowledge and adhere to our privacy and customer data handling policies.
5.4. Clearpath Partners. In order to provide its services, Authentic may share with its business partners, in a secure environment, your personal and traffic data. They are required to take measures to protect your personal and traffic data in accordance with the law. Authentic products and services may be licensed or co-branded and offered together with or directly by a partner company. If you register for or use such products, you consent to both Authentic’s and the partner company’s use of personal data collected in connection with the licensed or co-branded product. Authentic, Authentic’s local partner, or the operator or company facilitating your communication may provide personal data, communications content and/or traffic data to an appropriate judicial, law enforcement or government authority lawfully requesting such information. Authentic will provide all reasonable assistance and information to fulfill this request and you hereby consent to such disclosure.
5.5. Corporate Events. If we (or our assets) are acquired by another company, whether by merger, acquisition, bankruptcy or otherwise, that company would receive all information gathered by Authentic on the Websites and the Services. In this event, you will be notified via email and/or a prominent notice on our website, of any change in ownership, uses of your Personal Information, and choices you may have regarding your Personal Information.
6.1. Users in the United States. Clearpath stores and processes the data of US users within the United States.
6.2. International Users. We may partner with infrastructure service providers such as Amazon, Google, and/or Microsoft to provide access to our Services. Accordingly, your information may be stored and processed in any location in which these service providers or any of their affiliates, subsidiaries or service providers maintain facilities. Unless expressly agreed to in a negotiated agreement or prohibited by law, Authentic reserves the right to transfer information outside of your country, and by using the Services or websites, you consent to any such transfer of information outside of your country.
When you create a Clearpath account or have an account created for you by a Facility, any information provided pertaining to you will be stored and maintained by us. You can request to have your information deleted at any time by emailing support@myclearpath.com.
8.1. Analytics Software. In order to improve your user experience, we may use analytics software, including without limitation Google Analytics, Heap, Hotjar, Fullstory, or Mouseflow, from time to time to gather statistical and analytical information about how you use our Services.
8.2. Advertising & Promotion. From time-to-time, you may receive promotional materials from Authentic announcing product updates, special offers and/or featured content. Authentic and its promotional partners may use non-personally identifiable information that you have provided in your profile or otherwise provided to us, such as your age, gender, language, country of residence, time zone, as well as information about your relationship with our Services in order to provide offers and promotional materials likely to be of greater interest to you and to help us measure and improve the performance of our promotional campaigns.
8.3. Opt-out. You may opt out of promotional communications at any time by clicking the ‘Opt Out’ link at the bottom of emails, or managing your communications settings in your personal profile.
The Clearpath website and its web pages may contain links that allow you to leave the Clearpath website and access other websites. Such hyperlinked websites are not under the control of Clearpath and may have different privacy policies. The Clearpath Privacy Policy applies only to your personal information that is acquired on the Clearpath website and its web pages or through your use of our Services. We urge you to be careful when providing any personal information online and we accept no responsibility or liability for these other websites.
From time-to-time, we may ask you to provide information about your Clearpath experience, which we may use to improve our Services. You are at no time under any obligation to provide any such information. We reserve the right to use email, text messages and other communication methods to notify you of any claims related to your use of our Services, including without limitation claims of violation of any third-party rights.
Clearpath is not intended for or designed to attract users under the age of 13, and we do not intentionally or knowingly collect personal information on our websites from anyone under the age of 13. We encourage parents to be involved in their children’s online activities to ensure that no information is collected from a child without parental permission.
Headings or titles used herein are for convenience only and shall not be deemed to affect the meaning or construction of any of the terms, provisions, covenants, or conditions of this Privacy Policy.
Our Privacy Policy is effective as of June 2025 and last updated as of June 2025. We reserve the right to amend our Privacy Policy at any time. Your continued use of Clearpath following changes to our terms constitute acceptance of our amended terms.
